By accessing or using MedFOLIO's mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
These Terms constitute a legally binding agreement between you and MedFOLIO, Inc. ("MedFOLIO," "we," "our," or "us").
2. Eligibility
You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you:

- Have the legal capacity to enter into these Terms
- Are not prohibited from using the Service under applicable laws
- Will provide accurate and complete information when creating an account

- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Reverse engineer or attempt to extract the source code
- Use the Service to store information belonging to others without authorization
- Resell or commercially exploit the Service without permission
5. Health Information Disclaimer
MedFOLIO is not a healthcare provider. The Service is designed to help you organize and access your medical documents. We do not:
- Provide medical advice, diagnosis, or treatment
- Replace the relationship between you and your healthcare providers
- Verify the accuracy of documents you upload
- Make healthcare decisions on your behalf

6. Subscription and Payments
6.1 Free and Premium Plans
MedFOLIO offers both free and premium subscription plans. Premium features require a paid subscription.
6.2 Billing
If you subscribe to a premium plan:
- You authorize us to charge your payment method on a recurring basis
- Subscriptions automatically renew unless cancelled
- Price changes will be communicated in advance
6.3 Refunds
Refunds are provided in accordance with applicable laws and our refund policy. Generally, subscription fees are non-refundable except where required by law.
7. Intellectual Property
The Service, including its design, features, and content (excluding your personal data), is owned by MedFOLIO and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.
You retain ownership of all documents and data you upload to the Service.
8. Limitation of Liability
To the maximum extent permitted by law:
- MedFOLIO is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid us in the past 12 months
- We are not responsible for decisions made based on information stored in the Service
9. Indemnification
You agree to indemnify and hold harmless MedFOLIO and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Termination
We may suspend or terminate your access to the Service if you violate these Terms or for any other reason with notice. Upon termination:
- Your right to use the Service will immediately cease
- You may request a copy of your data within 30 days
- We will delete your data in accordance with our Privacy Policy
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
